The applicant has not entered into a Section 106 Agreement to pay a commuted sum to facilitate the provision of open space, street trees and public art, and as such, provision does not meet the needs of future occupiers of this development, contrary to Policies OE14, HD23 & HD24 of the Liverpool UDP.
